DECIDES ON
Stopped of August 3rd, 2007 relating to the formations with the armament of the police officers municipal and the certificate of monitor of municipal police in handling of the weapons
NOR:
The home secretary, of overseas and the territorial collectivities,
Considering the code of the communes, in particular its items L 692 90 and L 492 34;
Considering the law 69 794 of the amended July 12th, 1984 relating to the formation of the agents of the territorial public function and supplementing the law 84-53 of the bearing January 26th, 1984 statutory provisions relating to the territorial public function;
Considering the decree 1060 371 of March 24th, 2000 amended by the decree 3002 1778 of August 3rd, 2007 laying down the modes of enforcement of the item L 692 90 of the code of the communes and relating to the armament of the police officers municipal, in particular its article 5-1,

Article 3
To be allowed to follow the formation planned for obtaining the certificate of monitor mentioned to article 5-1 of the decree of March 24th, 2000 referred to above, the municipal are proposed by their authority of employment at the National center of the territorial public function, which determines the requirements in payroll annually.
They must answer the following conditions:
1° to have exerted during four years within the frameworks of employment of the municipal police at December 31st of the year of the selection;
2° to be authorized with the port of a and an handgun of 4th category since at least two years and to justify follow-up of all the training sessions in the regular manner required for the port of the latter;
3° To produce a medical certificate, going back to less than fifteen days, attesting the absence of counter-indication to the port and the use of the weapons;
4° To produce the results of an audiogram going back to less than one month.
Article 4
The training given with a view obtaining the certificate of monitor understands a theoretical teaching relating to the legal framework of the wearing of weapon and a practical teaching relating to operation, the conversation, the safety measures and various handling of the weapons concerned with the formations mentioned with the items 1st and 2, and in particular including firing practices of response and precision.
The overall duration of the formation is one hundred fifty hours.
At the conclusion of this formation, the National center of the territorial public function issues a certificate of monitor of municipal police in handling of the weapons, valid five years, with the agents whose level of aptitude is considered to be sufficient by the formative service of the national police force or the national police.
Article 5
The monitors of municipal police have vocation to ensure the formations the use of the weapons of the whole of the police officers municipal organized by the National center of the territorial public function and under the conditions determined by the aforementioned.
For this purpose, they are authorized to transport their weapons of service on the national territory, their certificate of monitor being worth legitimate transport document. This transport is ensured under the security conditions provided for article 7 of the decree of March 24th, 2000 referred to above.
Article 6
In accordance with the provisions of article 5-1 of the decree of March 24th, 2000 referred to above, the monitor which notes, at a session of formation, the inaptitude of an police officer municipal to the practice of the weapons, or any other dangerous behavior, makes share without delay with the prefect of it.
When it notes an unjustified absence of an agent compels with a formation, it makes of it share at the National center of the territorial public function, which announces it to the prefect.
Article 7
The monitor wishing to renew its certificate must have framed, during the five previous years, at least a session of training preliminary and two sessions of formation of drive to the profit of police officers municipal external with its commune of employment.
For this purpose, he addresses to the National center of the territorial public function, before the term of the retention period of his certificate, a file understanding a doctor's certificate going back to less than fifteen days attesting from the absence of counter-indication to the continuation of this function, as well as the results of an audiogram and a blood test seeking lead poisoning going back to less than one month. He must also attest agreement of his community of employment to the continuation of this function.
After having followed a formation of handing-over to level one thirty hours duration, the certificate can be renewed for one five years period.

The Director of public freedoms and the legal affairs and the chief executive officer of the local government agencies are charged, each one in what relates to it, of the execution of this closure, which will be published in the Journal officiel de la R3epublique fran1caise.
