BILL

PROTOCOL with the CONVENTION OF BACKUP OF the HUMAN RIGHTS AND Fundamental freedoms

 

 

 

 

The Foreign Minister forwarded a bill authorizing the adoption of the protocol 14 to the Convention of backup of the human rights and fundamental freedoms.

 

This protocol, adoptee in Strasbourg on May 13rd, 2004 by the Committee of the Ministers for the Council of Europe and signed by France the same day, aims at improving the monitoring system of the Convention whose European Court of the human rights is the angular stone. It confers at this court the procedural means necessary to reduce the time devoted to the repetitive businesses or obviously inadmissible and it facilitates the monitoring of the execution of its stops by the installation of a recourse in interpretation and a recourse in failure on the initiative of the Committee of the Ministers for the Council of Europe.

 

 

 

 


BILL

PROTOCOL WITH the CONVENTION CREATING EUROPEAN OFFICE OF FONT

 

 

 

 

The Foreign Minister forwarded a bill authorizing the adoption of the protocol of November 27th, 2003 established on the basis of article 43, paragraph 1, of the Convention creating European Office of font ( Convention) amending the aforementioned Convention.

 

The purpose of the European Office of font is to improve the effectiveness of the European police services and their co-operation to prevent and fight against the serious forms of international criminality.

 

The protocol of November 27th, 2003 aims at making it possible to effectively play its part of pivot of the European police co-operation while simplifying and by improving certain procedures. This agreement also provides for an intensifying of the control of the requests for data and a reinforcement of the role of the European Parliament, thus allowing a better democratic control of .

 

 

 

 

 


BILL

HARMFUL SYSTEM MONITORING ON THE SHIPS

 

 

 

The Foreign Minister forwarded a bill authorizing the accession to international convention on system monitoring vermin on the ships, adopted in London on October 5th, 2001 under the aegis of the international maritime Organization.

 

This Convention aims at prohibiting, on a world level, the use of the harmful products (organic compounds of tin) present in paintings of ship hulls, in order to protect the human health and the seamen circle.

 

If the majority of the rules laid down in the Convention are in force since May 2003 at the latest under the terms of Community and national texts, it is interest of France, initiator of the prohibition of these products since 1982, to promote a fast implementation to the international level of the measurements laid down in this Convention.

 

 

 

 

 

 


BILL

EQUALITY OF OPPORTUNITY

 

 

The Minister for employment, social cohesion and housing and the acting minister with the promotion of the equality of opportunity forwarded a bill for the equality of opportunity.

 

This bill has the aim of putting an end to the situations of inequality chances and discriminations whose the populations of the difficult districts are victims, particularly the young people. It aims strengthening social cohesion and at preserving our Republican pact. Within this framework, the bill pursues five goals:

 

1. - To support the employment of young people the resident in the disadvantaged urban areas or having problems of social and professional integration

 

The bill institutes the training junior which contains two phases: the training initial junior, which offer an initiation to the trades, and the training confirmed junior, during which the young person is under apprenticeship contract. This new framework allows a return to mainstream education, if the young apprentice formulates the request of it.

 

Access terms privileged with young contract the “in firm” are in addition created for the young people resulting from disadvantaged urban areas, until the twenty-five years age. The financing of the contract of professionalisation is in addition simplified.

 

Lastly, fifteen new free urban zones are created in order to promote employment for the benefit of the inhabitants of the ailing districts. On the whole, these are 100 free urban zones which will support employment in these territories.

 

2. - To strengthen the equality of opportunity and the fight against discriminations 

 

The bill provides for the creation of an national agency for social cohesion and the equality of opportunity in order to increase the presence of the State in the disadvantaged districts, to contribute to the fight against discriminations and to strengthen the shares of integration. This agency is charged to take actions in favor of the inhabitants residing in these districts and in management with the public ones encountering difficulties of social or professional integration on the unit of the national territory, in particular the immigrant populations. The Government strengthens its share thus, as well as regards policy of the city as in management of the insufficiently integrated populations. The project provides for, for this reason, the resumption and the continuation of the shares of the Funds of share and support for integration and the fight against discriminations .

 

The capacities of the High authority of fight against discriminations and for the equality (DUMP) are strengthened: it will have faculty to impose administrative sanctions.

2. -

The bill legalizes the practice of the tests to the (“”) and gives the Superior council of audio-visual (SCUMS) the mission of strengthening diversity within audio-visual French.

 

3. - To help the parents to exert their parental authority

 

The bill institutes a parental responsibility contract entrusted to the boards of director in connection with the academic services. This contract makes it possible to assign objectives with the parents and described the operative paragraph of social action which is associated there when the family circumstances justify it. If it is not adhered to by the family, the competent jurisdictions will be able to pronounce the temporary suspension of certain allowances.

 

4. - To strengthen the capacities of the mayors vis-a-vis incivilities

 

The capacities of observation of the municipal for certain infringments are wide. The mayor will be able, when these infringments are made on the communal territory but not with the prejudice of the commune, to propose with the parquet floor to resort to an alternative to the continuations. When they carried prejudice to a good of the commune, the mayor will be able to propose to the contravener a transaction forwarded to the homologation of the parquet floor.

 

5. - To create a voluntary civil service

 

The voluntary civil service will gather missions of greeting of young ages from 16 to 25 years exerted by right persons public or deprived, with a purpose of general interest or professional insertion. These missions make it possible to the young people to acquire a civic and vocational training as well as a first experiment. The missions of greeting will be approved by the National agency for social cohesion and the equality of opportunity under the voluntary civil service. The agency will contribute in addition to the financing of this partnership.

 

The bill strengthens the dynamics of the equality of opportunity in favor of the disadvantaged districts and of the young people in school rupture, in connection with their family, and it strengthens the fight against discriminations and for the diversity, whose media audio-visual must be a reflection.

 

Whereas significant shares are already engaged with, in particular, the social cohesion plan, the emergency plan for the suburbs and the measurements of state education, 2006 must be that of the great national cause of the equality of opportunity: during this year, will be carried and disseminated, with the support D `a collective of associations, the message of the promotion of the equality and fight against discriminations.

 

It is a question of giving again with all the citizens, whatever their origins, their beliefs or their personal choices of life, confidence in the equitable reconnaissance their merits and of their place in society.

 


BILL

TERRITORIAL PUBLIC FUNCTION

 

 

 

 

The deputy secretary with the autonomous regions forwarded a relative bill to the territorial public function.

 

This bill continues with three main aims:

 

1. - To develop vocational training throughout the life and taken into account professional experience at the territorial agents

 

The territorial agents will profit, like the employees of the private sector, of one individual right to the 20 hours formation a year; this right will be centered on training leadings to qualification of professional nature. The efforts of individual training provided by the territorial agents will be developed and taken into account for internal promotion.

 

The track records will be also taken into account in the course of career: it becomes, thanks to the mechanism of the reconnaissance of the track records, an equivalent of the obligatory statutory formation. The input in the territorial public function of people coming from the private sector will be facilitated by taken into account, during recruitments and for remuneration, of the already acquired professional seniority.

 

To improve integration of the agents of the category C in the autonomous regions, an initial training will be founded in favor of those which do not profit from it today.

 

2. - To give more flexibility in resource management human

 

In order to at least meet the need for managing staff of the communes of 2.000 inhabitants, those will be able to create a functional job of managing director of the services. The thresholds of creation of certain functional jobs are also lowered for the public body of inter-commune co-operation.

 

The bill provides that a territorial collectivity which recruits, by channel of transfer, an official whose formation was taken of charge by the budget of another community will have to compensate the aforementioned, if the transfer intervenes in the three years which follow establishment.

 

Lastly, the bill provides for a certain number of measurements tending to recognize with the territorial agents of new rights as regards trade union rights, hygiene, security and preventive medicine.

3. - To clarify the role of the various institutions intervening for the benefit of the territorial agents and their employers

 

Respective competences of the National center of territorial public function and the accounts centres are rebalanced. The is centred on its missions of professional training: he sees himself recognizing new responsibilities in this matter, particularly with regard to the reconnaissance of the professional experience and the validation of the assets of the experiment. The accounts centres see their role developing as regards organization of the contests and management of proximity of the territorial agents. They have thus vocation to play a pivot part as regards territorial public employment and estimated management of the payrolls, employment and competences.

 

In addition, a national public body of management is created, the National center of coordination of the accounts centres, in order to coordinate the share of the accounts centres and to deal with certain missions concerning the officials of category A.

 

The transfers of competences between the , the National center of coordination of the accounts centres and the accounts centres will be done gradually; Conventions relating to the transfer of the financings will be concluded. In the absence of Convention, they will be carried out by decree. The rebalancing of competences will intervene, in any event, without new expenditure for the territorial collectivities.

 

 

 

 

 

 


COMMUNICATION

Military operations outside the national territory

 

 

 

The Minister for defense made a presentation relating to military operations outside the national territory.

 

10 500 men and women of the French armed forces are currently engaged in a score of military operations outside the national territory. In 2005, seven soldiers lost the life in the achievement of their mission and 79 were wounded. A specific homage must be to them returned.

 

The vocation first of the commitments external of the armies is to ensure the protection of our fellow-citizens, in France and abroad. Taken into account threats which weigh on their security starts far from our borders.

 

By external operations, France prevents the constitution of areas of instability favourable with the terrorist activities or the development of the traffics.

 

In Afghanistan, the French soldiers are engaged to circumscribe the terrorist chambers and to rebuild the country. In or the Indian Ocean, it is also a question of restoring stability or of depriving terrorist and criminals of the means of acting. In #FFFFFF Coast, to , in Bosnia or in other more limited interventions, the presence of our forces contributes to the restoration of civil peace and the Rule of law.

 

In Southeast Asia, in Darfur, in New-Orleans, in Pakistan, the French soldiers showed that they could also be in first line to answer the great humanitarian crises.

 

In a context which does not let hope for a reduction in the crises and threats against our populations, the respect of the budgetary commitments undertaken within the framework of the military law of programming remains the key of our capacity to be acted.

 

The French Armies are brought to more and more often intervene within a multinational framework. Natural framework of our share, the European policy of security and defense must continue its amendment in order to answer the crises with the maximum of reactivity and effectiveness. France takes all its share there, while contributing to the transformation of NATO.

 

External operations are in the middle of the military trade, but also of the share external of our country. They make it possible France to be with the height of its responsibilities, to promote its securities, to constantly reaffirm its commitment in favor of worldwide stability and peace.

 

 


COMMUNICATION

The TRAINING IN Higher education

 

 

 

The Minister for state education, university education and search made a presentation relating to the training in university education.

 

For ten years, the training has very strongly progressed in higher education. It relates to 62 900 students, including 31.300 in the sections of high-level techniciens (including agriculture) and 31.600 registered voters in the superior educational institutions, against 12.400 at January 1st, 1995.

 

The Government wish that the number of apprentices in the whole of the educational institutions higher double from here 2010, parallel to the continuation of the development of the LT in training.

 

The development of the training requires the concluding of agreements with the professional branches and the large companies which finance it. It could also appear in the general conventions of partnership signed with the professional branches and the firms.

 

Contacts were also made with the Association of the areas of France in order to examine, within the framework of the competence of these autonomous regions as regards training, the conditions of a growth of this channel of formation in the superior educational institutions, in coherence with the development policy of each regional council. Unities of formation per training (or the Sections of training in the universities) will be created in the establishments which wish it, in partnership with CFA existing.

 

The possibility of recourse to the training will be systematized for the unit of the offer of formation registered with the national directory of professional certifications of the superior educational institutions, since it will correspond to the need for a firm or a branch. The possibility of resorting to the training will be integrated in the contractual policy between the ministry in charge of higher education and the superior educational institutions.

 

The development of the training in higher education takes part in the dynamics caused by the Government with a view reach in 2009 an objective of 500 000 apprentices, all confused levels of teaching.
